1. Introduction
1.1. These are the terms and conditions of OnlinePhotoPrinting.uk, referred to as “OnlinePhotoPrinting”, “we”, or “us”. These terms and conditions are referred to as “T&C’s”.
1.2. OnlinePhotoPrinting is located at 128 City Road London EC1V 2NX, United Kingdom. We are registered with the UK Companies House under number 14970354 with name RIPPLE18 LTD. Our VAT number is [Not Available Yet].
1.3. The term “customer” or “you” is defined as the person who uses our websites, our apps, registers and uses an account, uses our photo editor and other services, purchases our products, requests information, or shows interest in our products.

2. Applicability
2.1. These T&C’s apply to the use of our websites, apps, registration and use of an account, our photo editor, all our services, offers, orders you place, and agreements between us and you. They also apply to subsequent and additional offers, orders, and agreements.
2.2. When registering for an account or placing an order, you will be asked to accept these T&C’s. They are available for review and can be printed for later examination.
2.3. These T&C’s are electronically accessible on all of our websites and apps. Upon request, they will be sent to you without delay and at no cost.
2.4. You must ensure that the email address we hold for you is kept up-to-date. If you change your email address, update it on your account to continue receiving important messages from us.
3. Formation of the Agreement
3.1. Our offers are presented in our online order process. General offers on our websites, apps, emails, and promotional materials are for information purposes only.
3.2. You may accept our offer by making payment in the order process. The order process allows you to check and amend any errors before submitting your order. The order process is only available in English, and we will not file a copy of any contract formed between you and us. Upon receipt of your payment, your order is placed and the agreement is formed, provided the upload of your photos was successful.
3.3. We shall confirm receipt of your order by email immediately.
3.4. We reserve the right not to fulfil an order in certain circumstances, including but not limited to: breaching T&C’s, corrupted images, product unavailability, payment issues, or pricing errors. If we reject your order, we will contact you and reverse the payment.
4. Performance of the Agreement and Delivery
4.1. We will start processing your order immediately upon its formation.
4.2. We aim to start production of your order on the next workday following the agreement formation. Estimated delivery times are provided on our websites and apps and may vary based on time of year and other circumstances.
4.3. Delivery costs will be displayed during the order process.
4.4. We will provide you with a delivery period during the order process and confirm it in the Confirmation Email. Multiple products in one order may be shipped together, in which case the longest delivery time applies.
4.5. Orders are delivered by ordinary mail or carrier.
5. Prices and Payment
5.1. Prices in our emails and promotional materials are for information purposes only and may change.
5.2. Prices include VAT where applicable and exclude shipping costs and any import duties, levies, and taxes.
5.3. The price of your order and shipping costs are shown during the order process. Shipping costs for outside of the EU and the UK do not include applicable charges by the country, such as customs handling fees, import duties, levies, and taxes. Consult your local customs office for information.
5.4. Discount codes and promotions may be offered, with specific terms and conditions. Regular prices apply upon expiration of a discount code.
5.5. Information about available payment methods is provided on our websites and apps. Orders are placed by making payment, upon receipt of which the agreement is formed provided the photo upload was successful. We send a confirmation by email upon payment receipt.
6. No Cancellation Rights & Return Policy
6.1 Custom Orders: As our products are custom-made to your specifications, we cannot accept returns or offer refunds for items that are no longer wanted or were ordered in the wrong size. Please double-check your order details before completing the purchase.
6.2 Damaged or Incorrect Products: If your order arrives damaged or does not match what you ordered, please notify us within 14 days of receiving the product. We will require a photo of the damaged or incorrect item sent to our customer service team. You can choose to receive a replacement or a full refund, including any shipping costs.
6.3 Order Cancellations: If you need to cancel an order, please do so within 2 hours of placing it, as our production process begins swiftly. Unfortunately, we cannot cancel orders once production has started.
6.4 Refunds: Refunds will be processed within 14 days once we have confirmed the issue with your order. The refund will include the product cost and any related shipping expenses.
7. Conformity and Complaints
7.1. Our products have satisfactory quality and performance, and are fit for their intended purpose. The quality of prints depends on the quality of uploaded digital images.
7.2. If you are unhappy with your order or our service, notify us within 14 days of receipt for a fitting solution.
7.3. If the product you ordered is not in conformity with the agreement due to a clear deficiency or incorrect processing, inform us within two months from the date of detection. You have the right to a repair or replacement within our regular delivery times, free of charge.
7.4. Deleting digital photos from your account or terminating your account prevents us from reprinting your order.
7.5. If we cannot provide a remedy for the lack of conformity, you have the right to cancel the agreement and receive a full refund unless the lack of conformity is minor.
7.6. You must return non-conforming products upon our request. We will cover shipping costs.
7.7. We are not obliged to provide a solution for products damaged due to improper use or normal wear and tear.
8. Photo Storage / Photo Organizer
8.1. We allow you to upload and store your photos and related data to create photo products. This storage should not be your main or backup storage. Ensure your data is securely stored elsewhere.
8.2. We provide storage for active users who have placed at least one order in the past 18 months. You will be reminded before the end of this period to place a new order for another 18 months of access and storage. If no order is placed, your photos and data will be permanently removed.
8.3. We have data retention periods for account data, including photos and related data. After these periods, data will be deleted. More information is available on our website.
8.4. We are not responsible for the loss, deletion, or corruption of photos or other user content. We do not keep backup copies and have no liability for lost or corrupted data.
9. User Conduct
9.1. You are responsible for the use of your account and must comply with the T&C’s. Accounts are for individual use and must not be shared. Use your own name and contact details, and keep your password confidential. Notify us immediately if your account is used without permission.
9.2. You guarantee that photos uploaded do not infringe third-party rights, including intellectual property rights and privacy rights.
9.3. You guarantee that uploaded photos do not breach criminal law, statutory provisions, public order, public morality, or proper social conduct.
9.4. You guarantee that we are not breaching third-party rights or laws by processing your order.
9.5. You guarantee that orders are for private, non-commercial use and that you are acting as a consumer.
9.6. You guarantee that uploaded photos do not contain viruses, malware, or harmful software and will not compromise our services. You must not hack, spam, or use our services in a manner that disrupts integrity or performance. Do not collect or process personal data in breach of data protection laws.
9.7. You are liable for costs, claims, damages, or losses we incur due to your breach of these T&C’s.
9.8. We may cancel the agreement, delete your photos, suspend or terminate your account, and notify authorities if you breach the T&C’s or if required by law. We are not liable for any resulting damage.
9.9. Although we prohibit infringing content, we do not monitor or pre-screen user content. If you become aware of infringing content, please contact us.
9.10. Your image storage must comply with our fair use requirements. Breaching these may result in account suspension, cessation of storage, or deletion of images.
10. Availability of Our Services
10.1. We aim to keep our services available continually, but maintenance, updates, or disruptions beyond our control may occur. We are not liable for any resulting loss or damage.
10.2. Our services require a computer, mobile phone, or device with internet access and an up-to-date browser. You are responsible for securing your device and software. We are not responsible for errors or data loss during transfer via networks or facilities we do not control.
10.3. Access to our free services is offered without guarantee or warranty of performance. We may make changes to these services from time to time.
11. Intellectual Property Rights
11.1. All intellectual property rights related to our websites, applications, photo editor, and services belong to OnlinePhotoPrinting and its licensors.
11.2. You have a non-exclusive, non-transferable limited licence to access and use our services solely for personal benefit. Reproduction, modification, or public availability of our services is not permitted unless allowed by law.
11.3. We may take technical measures to protect intellectual property rights. You must not bypass this security.
11.4. Integration or combination of our services with non-OnlinePhotoPrinting software is not permitted. Decompilation, reverse engineering, or translation of our services is prohibited unless allowed by law.

13. Liability
13.1. We accept liability for loss or damage you suffer that is a foreseeable result of our breach of these T&C’s or our negligence, but not for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time the contract was formed.
13.2. We do not exclude or limit our liability to you where it would be unlawful to do so.
13.3. We are not responsible for loss or damage caused by events outside our reasonable control.
13.4. We are not responsible for business losses. We only supply the products for domestic and private use.
13.5. Our total liability to you for any loss or damage arising out of or in connection with these T&C’s or your order, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the price paid for the products.
